TERMS OF USE

Welcome to ATHLEIMAX. By accessing our website (https://athleimax.com) and/or engaging our manufacturing services, you agree to comply with and be bound by the following Terms of Use. Please read these terms carefully before placing orders or utilizing our services.

1. Manufacturing & OEM Orders

ATHLEIMAX operates as a professional manufacturer and exporter of sportswear, activewear, and streetwear. All custom orders (OEM / Private Label) are subject to the following conditions:

• Minimum Order Quantity (MOQ): MOQs vary depending on the product type, fabric requirements, and customization depth. Specific MOQs will be detailed in your formal quote.
• Sample Approval: Before bulk production begins, we typically manufacture pre-production samples. Once physical/digital samples are approved by the client, bulk production will strictly follow the approved sample specifications.

2. Payment Terms

Payments must be made according to the agreed milestones outlined in our invoices. Unless otherwise agreed in writing, standard payment terms for bulk orders are:

• A deposit (advance payment) of 50% is required to initiate material procurement and custom development.
• The remaining balance of 50% must be paid upon completion of production and inspection, prior to dispatch/export.

3. Shipment, Lead Times, & Customs

We export worldwide from Sialkot, Pakistan. Shipping rates, custom clearance duties, and logistics are subject to the following rules:

• Lead Times: Production lead times are estimations starting from the date of deposit receipt and design approval. We are not responsible for delays caused by raw material shortages, custom hold-ups, or force majeure events.
• Shipping Terms: Standard shipping is executed via reliable couriers (DHL, FedEx, UPS) or freight forwarders (Air/Sea) under Ex-Works (EXW) or FOB terms as agreed per transaction. Import duties, local taxes, and clearance charges are the sole responsibility of the buyer.

4. Intellectual Property & Brand Ownership

Clients are solely responsible for ensuring they own or possess the legal rights/licenses to all logos, slogans, graphics, and tech packs submitted to ATHLEIMAX for customization. ATHLEIMAX disclaims all liability for trademark or copyright infringement arising from designs provided by clients.

5. Quality Assurance & Claims

We stand behind our craftsmanship. Any issues regarding fabric quality, size variances outside international tolerances, print/embroidery errors, or manufacturing defects must be reported to us in writing within 10 business days of cargo arrival, accompanied by detailed photographic evidence. Approved claims will be resolved via replacement or credit adjustments.

6. Governing Law

These Terms of Use and any agreements for manufacturing services shall be governed by and construed in accordance with the laws and commercial regulations of Pakistan, without giving effect to any principles of conflicts of law.
